1. About these terms
These terms apply when you book a class, purchase a class pass or membership, or register for a workshop, special class or private session with us.
By making a booking or purchase, you agree to the terms that apply to that service at the time of purchase.
2. Class passes
Class passes are personal and cannot be transferred to another person.
Each pass is valid for the period shown when you purchase it. Unused classes expire when that validity period ends and cannot normally be carried over.
Where a pass is valid from your first visit, the validity period starts when you attend your first class using that pass.
Access to Mysore classes is included only when this is explicitly stated on the pass.
3. Introductory offers
Introductory offers, including the Welcome Pass and Introduction to Mysore, are intended for new students and may normally be purchased only once per person.
The number of classes, validity period and classes included are shown with each introductory offer.
We may ask you to choose another suitable pass if you have already used the same introductory offer in the past.
4. Memberships
Monthly memberships renew automatically each month until cancelled. The membership fee is charged for each new monthly period.
All Monthly memberships require a minimum commitment of 3 full months. After the first 3 full months, your membership continues for an indefinite period of time until you terminate your membership.with a termination period of 1 month, which termination period starts the first day of the month after the day you terminated your membership.
The Monthly Classes Membership includes studio classes and live streaming where available, but does not include Mysore unless this is explicitly stated.
The Monthly Online Pass is for online participation only and does not include attendance at studio classes.
Workshops, special events and private sessions are not included in a monthly membership unless explicitly stated otherwise.
5. Changes to membership prices
We may occasionally change the price of a recurring membership. Any change will apply only to future membership periods.
If the price of your existing membership changes, we will let you know before the new price takes effect. You may cancel your membership before the new price applies if you do not wish to continue at the new price.
Changing a listed price does not change the price or validity of a class pass that you have already purchased.
6. Booking classes
Classes are booked through our online booking system, Momoyoga. A valid pass or membership does not guarantee a place in a particular class. Classes may have limited capacity and should be booked in advance.
If you cannot attend a class you have booked, please cancel your booking through Momoyoga as early as possible so that the place can be made available to somebody else.
Early Cancellation
You can cancel your reservation up to 2 hours before the class start time without penalty. Your class credit will be returned to your account.
Refunds
In case of a no show or late cancellation, for whatever reason, no restitutions or refunds will be made unless explicitly stated otherwise.
Booking Suspension
In case of three or more no shows/late cancellations in a month, we reserve the right to temporarily suspend your advance bookings rights.
7. Workshops, special classes and events
Workshops, special classes and events are booked separately from normal class passes and memberships unless the event description explicitly says otherwise.
The date, time, location, price and any specific cancellation conditions are shown on the event page when you book.
Where an event has its own cancellation conditions, those conditions take precedence over the general class cancellation policy.
For example, where an event states that cancellation is possible up to seven days before it begins, a cancellation made within that period will be refunded. After that point, we will do our best to fill your place but cannot guarantee a refund.
8. Private and duo sessions
Private and duo sessions are arranged separately and are not included in standard class passes or memberships unless explicitly agreed.
Any cancellation conditions that apply to a private session will be communicated when the session is arranged.
9. Online purchases and cancellation rights
If you purchase a service online, any statutory cancellation or withdrawal rights that apply to your purchase remain unaffected by these terms.
If you ask us to begin providing a service during a statutory withdrawal period, different rules may apply once you have started using that service.
Certain bookings for an activity taking place on a specific date or at a specific time may also be treated differently under consumer law.
10. Schedule changes and cancellations
Occasionally we may need to change a teacher, class time or location, or cancel a class or event because of illness, insufficient attendance or circumstances outside our reasonable control.
Where we cancel a separately paid workshop or event, we will offer an appropriate alternative or refund the amount paid for that booking.
Minor changes to the regular weekly timetable do not normally entitle a member to a refund of their membership.
11. Your health and participation
Voluntary participation and assumption of risk
Participation in our yoga classes, workshops, events and related activities is entirely voluntary and at your own risk. You understand that physical exercise involves inherent risks of injury and physical strain.
Your health
You are responsible for ensuring that you are physically and mentally able to participate safely. In the event of pregnancy, injury, illness or a medical condition, please consult an appropriate healthcare professional before participating where necessary.
Please inform your teacher before class of any health condition, injury or limitation that may affect your practise. During practise, listen to your body and respect your personal physical boundaries.
Instructions, adjustments and suggestions provided by our teachers are intended as guidance. You remain responsible for deciding whether a posture, exercise or adjustment is appropriate for you.
Limitation of liability
Except where liability cannot legally be excluded, including in cases of intentional misconduct or deliberate recklessness, the studio and its instructors are not liable for personal injury, property damage, loss or theft occurring during or as a result of participation in our classes, workshops or other activities.
To the extent permitted by law, any liability of the studio is limited to the amount paid out under the studio's applicable liability insurance for the event concerned.
12. Personal belongings
Please look after your personal belongings while attending the studio. We cannot accept responsibility for loss or damage except where responsibility cannot legally be excluded.
13. Fair use
Unlimited memberships are intended for the personal practise of the named member. Memberships, passes and bookings may not be shared, resold or used commercially.
We reserve the right to refuse or end participation where someone behaves in a way that seriously disrupts a class, threatens the safety of others or repeatedly misuses the booking system.
14. Changes to these terms
We may update these terms from time to time, for example when our services or booking arrangements change.
Changes will not retrospectively alter the conditions of a completed purchase. Where a material change affects an ongoing membership, we will communicate it before it takes effect.
15. Governing law
These terms and the services provided by us are governed by Dutch law. Any dispute will be submitted to the competent court in the Netherlands, except where applicable consumer law gives you the right to bring proceedings before another competent court.
